Property rights suit against Hollywood continues

A Broward Circuit Court judge has allowed a developer to continue going after the City of Hollywood for property rights lost in a 2006 rezoning.

Judge William Haury denied the city’s motion to dismiss GSK Hollywood Development Group’s compensation claim on Friday, Daily Business Review reported. GSK sued the city for a due process civil rights violation and lost property rights in 2009 after being denied the chance to build a 15-story luxury condo building on Hollywood Beach. The company paid about $4 million for two properties in 2002 with the belief that it could build a 150-foot condo tower.

GSK’s project site is located near a 24-story condo building called Summit. After neighbors complained about the potential impact of another condo building, the City Council adopted an ordinance limiting building heights in the area surrounding Summit in 2006.

The city’s attorney argued GSK’s claim should be dismissed because it never submitted a formal development plan. [Daily Business Review] — Eric Kalis
